جستاری درباره «تاریخ فقه اسماعیلیه»

 Just as the lack of resources on the history of Ithnā'asharī Shiite jurisprudence makes it difficult to research and write about it, so does the history of Ismāīlī jurisprudence suffer from such a lack. Even more, speaking about Ismaili jurisprudence and its history with regard to their secret activities, especially before Fatimid rule is more difficult, in a way that this has led to the fact that the Ismāīlīs are sometimes accused of disregarding the jurisprudence and appearances of the Shari'a, which of course is not true of all the Ismaili sects (apparently only the Nizari are so). Professor Mohammad Vaezzadeh Khurasani is one of those who have paid attention to this issue and with a historical perspective that he learned from his professor, Ayatollah Boroujerdi, chose the subject of his presentation at the Sixth Iranian Research Congress held in Tabriz in 1975 as "relationship between Shiite jurisprudence And Ismaili jurisprudence. In this article, the author, using the manuscripts of Professor Vaezzadeh, presents a report on his research and makes some points about the book Daā'im al-Islam and Qāḍī Nu'mān, which he hopes will open the door to research in this field.  .

همان‌گونه که کمبود منابع در زمینه تاریخ فقه شیعه اثناعشری، تحقیق و نگارش درباره آن را دشوار نموده، تاریخ فقه اسماعیلیه نیز از چنین کمبودی رنج می‌برد، بلکه سخن گفتن درباره فقه اسماعیلی و تاریخ آن با توجّه به فعالیت‌های سری آنان به ویژه پیش از دوران حکومت فاطمیان دشوارتر است. حتی همین امر باعث شده است که گاه اسماعیلیان به بی اعتنایی نسبت به فقه و ظواهر شریعت متهم شوند که البته این ادعا درباره همه فرقه‌های اسماعیلی درست نیست.(ظاهرا تنها نزاریان چنین هستند) استاد محمد واعظ‌زاده خراسانی یکی از کسانی است که نسبت به این مسأله توجه نشان داده و با نگرشی تاریخی که از استاد خود، آیت‌الله بروجردی آموخته موضوع ارائه‌اش در ششمین کنگره تحقیقات ایرانی که در سال ۱۳۵۴شمسی در تبریز برگزار شده است را "رابطه بین فقه شیعه و فقه اسماعیلیه" قرار داده است. نگارنده در این نوشتار با استفاده از دست‌نوشته‌های استاد واعظ‌زاده، گزارشی از پژوهش ایشان ارائه داده و در حاشیه، نکاتی را درباره کتاب دعائم الإسلام و قاضی نعمان مطرح نموده که امید است باب پژوهش در این زمینه را بگشاید.  .
